After a vehicle accident, injured people in Massachusetts can typically turn to their own uninsured motorist coverage if the other driver has no insurance. Massachusetts requires auto policies to include this coverage, and it generally applies when the at-fault driver has no insurance, cannot be identified, or carries too little to cover the losses. It works alongside PIP, which pays medical costs first regardless of fault.
A claim under your own policy is still a claim, and the insurer can question the injury, the medical bills, or whether the other driver truly lacked coverage. Many policies send disputes to arbitration and set their own notice terms, which may differ from the three-year deadline for lawsuits.
The available coverage can depend on the policy terms and the circumstances surrounding the accident. Records such as medical bills, treatment notes, wage-loss documentation, and information about the other vehicle's insurance may become relevant during the claim process.
If the other driver cannot be identified, such as in a hit-and-run, additional requirements may apply before uninsured motorist benefits are available. Policyholders should also review their declarations page and policy language to understand applicable limits, exclusions, notice requirements, and procedures for resolving disputes.
It is common that insurers try to dispute fault in order to pay less. To avoid this, it is important to keep medical records, bills, the police report, and any proof of the other driver's insurance status. All this documentation gives a car accident lawyer more to work with when reviewing the policy.
