The Stoughton Police responded to the area of 1378 Washington Street, also known as Route 138, shortly after 5 a.m. following a 911 call reporting that a bicyclist had been hit by a vehicle. Emergency units arrived to find 39-year-old Mark Salvador on the ground.

Salvador, of Stoughton, was taken by ambulance to a Boston hospital. He was pronounced dead about an hour later.

The collision remains under active review.

Our condolences are extended to Salvador's family during this difficult time.

Who Can File a Wrongful Death Claim in Stoughton, MA?

In Massachusetts, a wrongful death claim must be filed by the executor or personal representative of the deceased person's estate, though the lawsuit itself is brought on behalf of surviving family members, such as a spouse, children, or parents, who may be entitled to recover damages. If no representative has already been named, a probate court can appoint one so the claim can move forward.

Families pursuing these claims can seek compensation for funeral and burial costs, the deceased person's lost income, and the loss of companionship and guidance surviving relatives now face.

Massachusetts law also allows a related survival action, which addresses pain and suffering the deceased experienced between the time of the wreck and their passing. Together, these claims aim to reflect both the financial and personal toll a family carries after losing a loved one.

Massachusetts generally gives families three years from the date of the accident to file a wrongful death claim, though this window can shift depending on the circumstances of the case.

Evidence like medical records, financial documentation, and other can strengthen a claim before memories fade or records become harder to obtain.

A Massachusetts wrongful death lawyer can help identify who qualifies as a personal representative, organize the necessary paperwork, and evaluate what damages may be available under Massachusetts law.
