August 4, 2026

Wilbraham, MA (August 4, 2026) – This article follows up in a story we covered earlier. You can read the original report here.

A woman has died following a two-vehicle crash last Wednesday, July 29, on Boston Road near Post Office Park.

The Wilbraham Police said one of the vehicles struck a tree, trapping the woman inside. She was taken to the hospital, where she was later pronounced dead.

No further details about the other driver or vehicle involved have been released.

The collision remains under investigation by local police.

Our sincere condolences go out to the woman's family and loved ones.

Survival Claims Under Massachusetts Law After a Fatal Crash

Separate from a wrongful death claim, Massachusetts law also allows a survival action, which lets the deceased victim's estate pursue compensation for what she personally experienced between the crash and her death. This includes any conscious pain and suffering the victim endured in the crash, along with their medical expenses and any property damage, rather than the losses her family experienced after the passing.

Evidence such as emergency response records, hospital documentation, and witness accounts from the scene can help clarify what she experienced before she reached the hospital. A Massachusetts wrongful death lawyer can be useful in gathering these records early, since some details can be harder to establish the longer a case sits without documentation.

Massachusetts allows a survival action to be brought alongside a wrongful death claim, though the two serve different purposes and compensate for different losses. The survival action must generally be filed within three years, and it's typically pursued by the personal representative of the estate rather than individual family members.

Because both claims can proceed together, understanding how damages are divided between the estate and surviving family members usually requires a closer look at the specific facts of the crash.

Sorting out how a survival claim fits alongside other legal options isn't always straightforward, especially when the details of what happened in the moments after a crash aren't fully clear. Our team at Fiorentino Legal, P.C. can help families understand what a survival action covers and how it might apply to their case.

If you're trying to sort through these options, you can call Attorney Christopher Fiorentino of Fiorentino Legal, P.C. at (617) 990-2568 to talk through what happened with our team.
