What Should Injured Drivers Know About Massachusetts No-Fault Insurance in Eastham, MA?

Massachusetts follows a no-fault insurance system, which means an injured driver or passenger will typically first seek payment for medical expenses and certain lost wages through their own Personal Injury Protection (PIP) coverage, regardless of who caused the collision.

This system is designed to provide prompt access to benefits while limiting smaller liability claims. However, it does not prevent every injury victim from pursuing a claim against the at-fault driver.

When injuries are serious or medical expenses exceed the thresholds established under Massachusetts law, an injured person may be able to step outside the no-fault system and seek additional compensation from the driver who caused the collision.

Depending on the circumstances, that claim may include damages for pain and suffering, future medical care, and other losses not fully covered by PIP benefits. It is important to understand whether a case meets those legal requirements, since it is usually one of the first questions after a significant crash.

Medical records, treatment bills, and documentation of lost income can all become key to determining whether a person qualifies to pursue a liability claim beyond no-fault benefits. Reviewing that information alongside the available evidence may help clarify the legal options available, and a car accident lawyer can explain how Massachusetts insurance laws apply to the specific facts of the case.

Our team at Fiorentino Legal, P.C. can explain how Massachusetts no-fault laws may affect your situation and discuss the legal options available to you. Every claim depends on its own facts, and obtaining reliable information early can help you make informed decisions.
