Medical bills and missed paychecks usually start before anyone knows who was at fault. Massachusetts uses a no-fault system to cover part of that gap. Personal injury protection, known as PIP, generally pays up to $8,000 in medical expenses and often lost wages, no matter who caused the wreck.
That $8,000 can go quickly after an ambulance ride, imaging, and follow-up treatment. Health insurance may cover bills once PIP is used up. A claim against the at-fault driver for pain and suffering generally requires more than $2,000 in reasonable medical expenses or an injury such as a fracture, loss of sight or hearing, permanent serious disfigurement, or loss of a body part. A death also meets the threshold.
Bills and records help show whether a claim meets that threshold; itemized statements, provider notes, and proof of lost wages carry real weight. In such cases, a car accident lawyer can help track which bills count toward the threshold, coordinate PIP with health insurance, and keep the three-year filing deadline for most Massachusetts injury claims in view.
Once medical bills start arriving, it is not always clear how no-fault benefits and the injury threshold fit together. Our team at Fiorentino Legal, P.C. can review your PIP coverage, treatment bills, and health insurance statements with you.
