How Insurance Works After an Accident in Massachusetts

If you are injured in a car accident in Massachusetts, your own insurance company usually pays your initial medical bills and lost wages through Personal Injury Protection (PIP). Because Massachusetts is a "no-fault" state, this coverage applies regardless of who caused the crash.

Every standard Massachusetts auto policy includes at least $8,000 in PIP benefits. This money is designed to get you quick medical care without waiting for a legal battle to finish. PIP typically covers 100% of your medical expenses (up to the limit) and 75% of any wages you lose if you are unable to work. To access these funds, you must file a claim with your own provider and provide medical records that prove your injuries were caused by the collision.

While PIP covers the basics, it does not pay for "pain and suffering." In Massachusetts, you can only sue the at-fault driver for these additional damages if your medical bills exceed $2,000, or if the accident resulted in a serious injury like a broken bone or permanent scarring. In these types of situations, an attorney can help you track every physical therapy session and doctor's visit to ensure you meet this legal threshold, allowing you to seek a much larger settlement from the other driver's insurance company.

Shortly after a crash, the other driver's insurance company will likely call you to ask for a "recorded statement." Their goal is often to find a reason to pay you less or blame you for the accident. A lawyer acts as your shield, handling all communications with insurance adjusters so you don't accidentally say something that hurts your case. They also investigate if the other driver has enough "Bodily Injury" coverage to pay for your long-term recovery, ensuring you aren't stuck with unpaid bills if your treatment costs more than the PIP limit.

After a crash on this road, a car accident lawyer can help with the accident report, evidence collection and revision, insurance negotiations, and more.
