More than one party may be liable when a commercial truck causes harm in Massachusetts. That can include the driver, the employer that assigned the work, the company that owns the truck, or a business that maintained it. Which of them can be pursued depends on who controlled the truck and how it was being used.
Employers can be liable for a worker's driving when the driver was acting within the scope of the job. Negligent hiring, training, or supervision can also be a separate basis for a claim.
In Massachusetts, proving a person owns a car is usually enough to legally assume the driver was operating it on the owner's behalf, which can change where a dispute starts. Additionally, commercial policies may also carry higher limits than personal auto coverage, so identifying every potentially liable party can matter.
In these cases, records usually decide who is named in a claim. Maintenance logs, driver qualification files, dispatch records, and delivery schedules can show how a truck was used and who controlled it.
Trucks that travel through Massachusetts on roads like Route 53 or Route 139 may belong to a local business, a regional fleet, or a rental company, and each arrangement can change who is liable. A truck accident lawyer in Massachusetts can help identify which parties may be involved, ask that records be preserved before they are lost or altered, and review the insurance policies that may apply.
