Who Can File a Wrongful Death Claim in Massachusetts?

In Massachusetts, only the personal representative of the deceased person’s estate can file a wrongful death claim. That representative acts on behalf of surviving family members who may be entitled to compensation. The claim is brought through the estate, not directly by grieving relatives.

The personal representative is typically named in the deceased person’s will. When a will exists, that individual steps into the role and carries the legal authority to move forward with a claim. Courts look to this document first when identifying who holds that responsibility.

If there is no will, a probate court appoints a personal representative. That process involves a legal petition and a judge’s decision on who is best suited to act. Family members may seek an appointment, but the court makes the final determination.

Surviving spouses, children, and other next of kin are the people who stand to benefit from a wrongful death recovery. They do not file the claim on their own behalf. Their connection to the deceased determines what share of any recovery they may receive.

Massachusetts wrongful death law allows compensation across several categories. These may include lost income the deceased would have earned, medical costs incurred before death, and funeral expenses. The law also recognizes non-economic losses like the loss of companionship and parental guidance.

A deadline applies to wrongful death claims in Massachusetts. The personal representative generally has three years from the date of death to file. Missing that window can bar the claim entirely, regardless of how strong the case may be.

Consulting a car accident lawyer can help clarify who qualifies to act as a personal representative. An attorney can also explain what documentation is needed and how the claim process works from start to finish. Legal support can make the process more manageable for a family dealing with a significant loss.
