What Are My Rights if I Am Injured in a Multi-Passenger Crash in Charlton, MA?
In Massachusetts, every person injured in a motor vehicle accident, whether they were a driver or a passenger, is entitled to Personal Injury Protection (PIP) benefits. This "no-fault" coverage is designed to pay for your medical bills and a portion of your lost wages immediately, regardless of who caused the crash.
In these types of cases, your medical expenses are generally covered up to the first $8,000 by the insurance policy of the vehicle you were in (or your own household policy). Because highway accidents often involve high speeds and significant force, hospital bills can exceed this $8,000 limit very quickly.
Once your medical costs surpass $2,000, or if you sustain a permanent injury or a fracture, you have the legal right to file a claim against the at-fault driver for "pain and suffering" and other damages not covered by PIP.
In a two-car crash with multiple passengers, the at-fault driver’s liability insurance may have to be shared among all the injured parties. This can lead to a "race for the policy limits" where there isn't enough money to fully compensate everyone.
A car accident attorney in Charlton can help by investigating all possible sources of insurance, including "Underinsured Motorist" coverage on your own policy, to ensure you aren't left with unpaid medical bills or long-term care needs.
