Child Hurt After Bicycle Struck by Vehicle on Holyoke St in Lynn, MA

September 15, 2026

Lynn, MA (September 15, 2026) – A child was hurt on Monday, September 14, after being struck by a vehicle while riding a bicycle near Holyoke Street and O'Callaghan Way.

The crash prompted a large response from emergency units. Lynn Police indicated the child may have been trapped beneath the vehicle, though this had not been confirmed.

The extent of the child's injuries has not been released. Emergency units worked at the intersection to assist the young cyclist.

The circumstances surrounding the accident remain under investigation.

We are thinking of the child and their family during this difficult time.

Legal Protections for Children Struck While Biking in Lynn, MA

When a child is hurt while riding a bicycle, Massachusetts courts generally hold that child to a different standard than an adult when evaluating their own actions leading up to a crash.

Younger children in particular tend to be presumed less capable of recognizing danger or reacting the way an adult driver or cyclist might, which can shape how fault gets analyzed in a case like this. This distinction matters because it can affect whether a child's own conduct is weighed against them at all.

Massachusetts follows a modified comparative negligence rule for personal injury claims generally, which means an injured party can recover compensation as long as they are not more than 50 percent at fault.

For a young child, courts usually apply a lower threshold when considering whether the child could have appreciated the risk involved, which can make this standard more favorable in cases involving very young cyclists.

Young children typically cannot pursue a claim on their own, so a parent or legal guardian usually files on the child's behalf, and any settlement may require court approval to make sure it's in the child's best interest.

Medical documentation plays a central role in these cases, particularly when injuries are still being evaluated or treatment is ongoing. A personal injury attorney can help parents understand how these protections apply and what steps are involved in pursuing a claim for a child.
