How Is Fault Disputed in a Crash in Dighton, MA?
Fault in a two-vehicle crash comes down to comparing each driver's account of what happened, along with physical evidence such as the final position of both vehicles, especially when one ends up off the roadway entirely. Investigators typically look at factors like speed, lane position, and whether either driver had the right of way leading up to the collision.
Disputes over fault can arise when drivers give conflicting versions of events, or when an insurance company argues that both parties share some responsibility for the crash. Massachusetts follows a modified comparative negligence rule, which means a driver found more than 50% at fault cannot recover damages, while a driver found 50% or less at fault may still recover compensation reduced by their share of responsibility.
People involved in this type of crash, particularly when a vehicle leaves the roadway, can experience injuries ranging from whiplash and bruising to more serious harm like fractures or head trauma, depending on the speed and force involved. Even when both drivers report feeling alright at the scene, some injuries take time to become apparent.
A car accident lawyer can help someone in this situation gather evidence such as the police report, photos of the scene, and any available witness statements to help support their version of events and push back against an unfair fault determination.
