We hope for a full recovery of the injured cyclist.

What Rights Do Cyclists Have at Intersections in Newton, MA?

Massachusetts law gives cyclists the same rights and responsibilities as drivers at intersections, which means a cyclist with the right of way at an intersection is entitled to proceed without yielding to a turning or merging vehicle.

Massachusetts also has a specific statute that requires drivers to leave at least three feet of clearance when passing a cyclist, a rule that becomes relevant when investigators look at whether a turning or passing vehicle gave a cyclist enough room.

Cyclists struck by vehicles can suffer more severe injuries than occupants of either vehicle in a typical car crash, since a bicyclist has no surrounding frame to absorb the force of impact, which leads to higher rates of fractures, road rash, and head injuries even at relatively low speeds.

Massachusetts gives injured cyclists three years from the date of the crash to file a personal injury lawsuit under the state's statute of limitations, and that timeline applies whether the claim is against the driver's insurance or, in some cases, the cyclist's own underinsured motorist coverage.

A personal injury lawyer can help with the gathering of crucial evidence such as traffic signal timing, witness accounts, or police reports. It is important to start this process early since some evidence tends to become unavailable after some time.
