Dracut, MA — Man Killed in Rollover Crash on Merrimack Ave

May 6, 2026

Dracut, MA (May 6, 2026) — A catastrophic two-vehicle collision claimed the life of a Tyngsborough man on Tuesday, May 5,on Merrimack Avenue. The accident, which involved a rollover and a vehicle ejection, triggered a massive emergency response and an intensive search operation.

At approximately 8:35 p.m., Dracut Police and Fire departments were dispatched to the vicinity of 166 Merrimack Avenue. Upon arrival, responders discovered a Jeep Wrangler on its side with severe rollover damage and a Subaru Forester with significant impact damage.

The driver of the Jeep, identified as 48-year-old Damian Torres, had been ejected from the vehicle and was found unresponsive on the roadway. PrideStar EMS and Dracut firefighters performed continuous life-saving measures and CPR while transporting Mr. Torres to Lowell General Hospital. Despite these exhaustive efforts, he was later pronounced deceased.

Two occupants of the Subaru, a woman and a teenager, were treated at the scene for non-life-threatening injuries.

The investigation into the cause of the accident remains active.

We extend our sincere condolences to Damian Torres's loved ones during this difficult time.

Liability and Evidence Preservation in Massachusetts Rollover Accidents

Recovery after a serious crash requires balancing immediate medical care with proactive evidence gathering to ensure legal accountability. Identifying the root cause of a crash involves forensic accident reconstruction, analysis of vehicle safety systems, and investigation of roadway conditions.

1. The Role of Accident Reconstruction Experts

Accident reconstruction experts analyze skid marks, vehicle rest positions, and crush patterns to calculate the speed and angle of impact. This data is critical in determining whether the collision was caused by a failure to yield, excessive speed, or an illegal maneuver by one of the drivers. Proving fault is the first step in a liability claim against a negligent party’s insurance.

2. Investigating Potential Vehicle Safety Failures

A legal investigation will examine whether the vehicle’s safety features, such as electronic stability control (ESC), roof strength, or seatbelt pretensioners, performed as intended. If a mechanical defect or a failure in a safety system exacerbated the injuries or contributed to the accident, there may be grounds for a product liability claim against the vehicle manufacturer in addition to a claim against the at-fault driver.

3. Claims for Wrongful Death and Loss of Consortium

When an accident results in a fatality, the executor of the estate can file a wrongful death action to recover for funeral expenses, medical bills incurred prior to death, and the loss of future earnings. Additionally, surviving family members may be entitled to loss of consortium damages, which compensate for the loss of companionship, guidance, and support.

4. Preserving Electronic Data and Telemetry

Modern vehicles are equipped with Event Data Recorders (EDRs). This "black box" data provides a precise record of speed, braking, and steering input in the five seconds leading up to the crash. Because this data can be lost if a vehicle is scrapped or repaired, a spoliation letter must be sent immediately to the insurance companies and tow yards to legally mandate the preservation of this evidence.
