What Is the Statute of Limitations for a Fatal Crash in Dedham, MA?

Families who lose a loved one in a fatal crash in Dedham, MA, generally have three years from the date of death to file a wrongful death lawsuit under Massachusetts General Laws Chapter 229, § 2. The statute allows an executor or administrator of the deceased person’s estate to pursue damages when negligence or other qualifying conduct caused the death.

Compensation in a Massachusetts wrongful death claim may include funeral and burial expenses, lost financial support, and the value of services, companionship, guidance, and other benefits the deceased provided to eligible survivors. In certain cases involving malicious, willful, wanton, reckless, or grossly negligent conduct, punitive damages may also be available.

After a fatal crash in Dedham, families should preserve crash reports, medical records, photographs, insurance information, witness statements, employment records, and funeral expenses. These documents may help establish how the crash occurred and demonstrate the financial and personal losses connected to the death.

Because the Massachusetts wrongful death statute of limitations is generally three years, families should determine the applicable deadline as soon as possible. Certain circumstances can affect how limitation periods apply, so the specific facts of the claim should be reviewed before assuming the deadline.

Once these records have been gathered, a legal review may help families identify which information could be relevant to a potential claim. At Fiorentino Legal, P.C., we have helped families across Massachusetts navigate the claims process in cases like this one and review the options that may be available while an investigation continues.
