What Is the Deadline to File a Three-Vehicle Crash Claim in Newton, MA?

In Massachusetts, a person generally has three years to file a personal injury lawsuit after a three-vehicle crash. Massachusetts General Laws Chapter 260, Section 2A requires most personal injury tort actions to be commenced within three years after the claim accrues.

This deadline can apply when a Newton crash causes injuries involving multiple vehicles. A three-vehicle collision may raise questions about how each driver contributed to the injuries, making evidence such as crash reports, photographs, witness statements, vehicle damage, and available video important to preserve.

Massachusetts also follows comparative negligence rules under Chapter 231, Section 85. If an injured person is found to be negligent, damages may be reduced according to that person's share of negligence. Recovery is generally allowed when the person's negligence is not greater than the total negligence attributed to the parties against whom recovery is sought.

The three-year period is not necessarily the same for every possible claim arising from a crash. Different rules can apply to wrongful death claims, claims involving government entities, or other circumstances. Filing deadlines can also depend on when the cause of action accrued, so identifying the applicable deadline early can help preserve a potential claim.

When questions arise about responsibility or a potential claim, a car accident lawyer can review the available evidence, medical records, witness information, and insurance documents to explain what legal options may apply.
