Wilmington, MA (September 13, 2026) – A juvenile bicyclist was reportedly struck by a car near Glen Road and Brattle Street in Wilmington on Saturday evening, September 12.
Emergency crews responded after the bicyclist was reported on the ground and possibly had briefly lost consciousness. Later updates indicated the patient was off Glen Road on the Brattle Street side as medical units responded.
The investigation into the crash remains ongoing.
We hope the young bicyclist receives the medical attention they need and makes a full recovery.
Comparative negligence can affect how much an injured bicyclist may recover after a bicycle accident in Wilmington, MA. Under M.G.L. Chapter 231, § 85, an injured person may recover damages when their negligence is not greater than the total negligence of the parties against whom recovery is sought. Any damages awarded are reduced in proportion to the injured person’s percentage of fault.
For example, if a bicyclist has $100,000 in damages and is found 20% responsible for the accident, the potential recovery could be reduced to $80,000. If the bicyclist’s negligence is greater than the combined negligence of the parties from whom recovery is sought, Massachusetts law can bar recovery.
Evidence can be important when determining how responsibility should be divided. Crash reports, photographs, witness statements, vehicle damage, traffic-camera footage, roadway conditions, and available bicycle-camera footage may help establish how the accident occurred and whether another party contributed to the injuries.
Massachusetts law also places the burden of proving negligence that would reduce or bar a plaintiff’s recovery on the party asserting that negligence. The plaintiff is presumed to have been exercising due care.
Understanding comparative negligence can therefore be important when evaluating a Wilmington bicycle accident claim, particularly when the actions of the bicyclist and another road user are disputed.
A bicycle accident lawyer can review the available evidence, medical documentation, insurance information, and financial losses. An attorney may also explain what legal options could apply based on the circumstances of the bicycle accident.
