How Is Liability Determined in a Multi-Vehicle Crash in Harwich, MA?

Liability in a multi-vehicle crash in Massachusetts is typically determined by comparing each driver's actions against the standard of care a reasonable driver would have used, including speed, following distance, and merging behavior.

Massachusetts follows a modified comparative negligence rule, meaning a driver can still recover damages as long as they are found less than 51% at fault, though their share of responsibility reduces what they can collect.

Sorting out liability becomes more complicated when a chain-reaction crash involves three or more vehicles, since each driver's role in the sequence must be looked at separately. People hurt in these crashes often deal with whiplash, fractures, or head injuries, some of which are not obvious until hours or days later.

A Massachusetts car accident lawyer can help by reviewing available reports, vehicle positioning, and traffic patterns to help establish how each driver's actions may have contributed to the crash. Because liability can be split between multiple parties under Massachusetts' comparative negligence standard, having a clear picture of what happened matters for anyone seeking compensation.
