What Legal Options Does a Police Officer Have After Being Hit by a Vehicle in Lawrence, MA?

When a police officer is injured by a vehicle while on duty in Lawrence, Massachusetts, they are generally entitled to workers' compensation benefits. These benefits can cover medical expenses and a portion of lost income during their recovery.

However, workers' compensation alone may not fully address the scope of losses that result from serious injuries, and a separate civil personal injury claim against the driver responsible may also be available depending on the circumstances. Consulting a personal injury attorney early helps ensure that all applicable avenues are identified and that no critical deadlines are missed.

The distinction between workers' compensation and a civil personal injury claim is important for officers hurt in a vehicle-related incident.

Workers' compensation provides benefits regardless of fault but is generally limited in the types of damages it covers, such as pain and suffering, for example, which are not compensable under workers' compensation. A civil claim against the at-fault driver, by contrast, may allow the officer to pursue a broader range of damages, including compensation for pain and suffering, permanent impairment, and the long-term impact of serious injuries on quality of life and career.

In Massachusetts, an injured worker can generally pursue both workers' compensation benefits and a third-party civil claim simultaneously, making early legal guidance especially valuable in cases involving serious injuries.

An attorney may be able to help an injured officer understand the full scope of compensation that may be available across both workers' compensation and civil legal channels, identify all applicable insurance coverage, and ensure that any resolution reached genuinely reflects the lasting impact of the injuries sustained.
