Massachusetts law does not give pedestrians an automatic right of way everywhere. Drivers must yield to pedestrians within marked or unmarked crosswalks at intersections, but pedestrians crossing outside those areas are generally expected to yield to oncoming traffic, which can affect how fault is divided after a wreck.
Massachusetts follows a modified comparative negligence rule, which allows recovery as long as the pedestrian is not found more than 50 percent responsible. This means that there are options available even if a pedestrian is found partly at fault.
Insurance companies typically argue a pedestrian's own actions contributed to what happened, which can reduce, but not necessarily eliminate, the compensation available afterward.
Determining exactly where a pedestrian was crossing, and whether traffic signals or crosswalk markings were present, can significantly affect how liability is assessed. A pedestrian accident lawyer can help gather photographs, witness statements, and roadway records to establish these details before they become harder to verify.
