In Massachusetts, a wrongful death claim is generally brought by the executor or administrator of the deceased person’s estate. The claim may seek compensation for certain losses suffered by eligible family members.
When a family loses someone suddenly, one early issue is determining who has been appointed to represent the estate. That person brings the wrongful death claim on behalf of those who may be entitled to recover.
If no estate representative has been appointed, the family may need to begin the probate process before the wrongful death case can move forward. This may be especially important when several relatives have an interest in the claim.
Because compensation may depend on how the crash happened, the investigation can also play an important role. Vehicle movement, roadway evidence, video, and other available information may help determine whether another party was responsible.
Depending on the circumstances of the case, Massachusetts wrongful death law may allow families to recover compensation for losses such as financial support, companionship, guidance, and certain funeral expenses.
When questions come up during the process, a wrongful death attorney can explain who may file the claim and what to expect as the case moves forward. A lawyer can also help address issues that could delay or complicate the claim.
