Hyannis, MA (September 15, 2026) – A police officer was seriously hurt Sunday night, September 13, after being struck by a vehicle while directing pedestrian traffic near the Cape Cod Melody Tent. The wreck happened around 10:05 p.m. as a concert let out at 41 West Main Street.
The officer was standing in a marked, illuminated crosswalk equipped with flashing lights and wearing a reflective jacket at the time.
A vehicle traveling eastbound entered the crosswalk and struck the officer. Bystanders and Melody Tent staff began helping the officer before emergency units arrived and took the officer to Cape Cod Hospital for treatment. The extent of the officer's injuries has not been detailed.
The driver, a 43-year-old man from Osterville, was arrested at the scene. He faces charges including operating under the influence for a second offense, operating under the influence with serious injury, and negligent operation of a motor vehicle.
Hyannis Police continue to investigate.
Our thoughts are with the officer as he continues to recover.
A DUI arrest can strengthen a civil claim in Hyannis by providing evidence that supports a finding of negligence, even though criminal and civil cases move forward separately. When a driver faces charges like operating under the influence, the police investigation usually includes field sobriety results, breath test evidence, and officer observations that can later be used in a related civil case. This evidence can help establish that a driver breached their duty to operate a vehicle safely.
Massachusetts allows an injured pedestrian to pursue a negligence claim regardless of the outcome of a related criminal case, since the two proceedings apply different legal standards. A criminal conviction is not required for a civil claim to succeed, and a civil case can sometimes move forward even before criminal charges are resolved.
When a driver strikes someone in a marked crosswalk, Massachusetts law generally places a heightened duty on drivers to yield to pedestrians using that crossing. Evidence that the crosswalk was illuminated and that the pedestrian was clearly visible can be significant in establishing fault. A pedestrian accident lawyer can help gather police reports, witness statements, and any available criminal case evidence to build a strong civil claim.
