In Springfield, a wrongful death claim is filed by the personal representative of the estate, meaning the executor or administrator appointed through the probate process. That representative brings the claim for the benefit of family members such as a spouse, children, or parents. The law generally sets a three-year deadline that runs from the date of death, so the timing of that appointment matters.
Recoverable damages are defined by statute rather than left open-ended. They can include the fair monetary value of the loss of the person's expected income, services, guidance, and companionship, along with reasonable funeral and burial costs.
Where a driver's conduct was grossly negligent, willful, or reckless, Massachusetts law also allows punitive damages, which are separate from those losses.
Many families in Springfield and across Massachusetts find that a fatal motor vehicle accident raises questions about more than one insurance policy. Sorting out which policies apply, and who should be named in the claim, usually takes a close review of medical bills, employment records, and the estate's paperwork.
To make the process easier, a wrongful death lawyer in Massachusetts can help a family gather those records, explain how the statute values a loss, and keep track of the filing deadline while they handle funeral arrangements.
