How Is Fault Divided in a Three-Vehicle Accident in Randolph, MA?

When three vehicles are involved, determining fault can require examining each driver's conduct rather than assigning responsibility to only one person. Massachusetts uses a comparative negligence system under which an injured person's damages may be reduced by their percentage of fault. An injured party can recover damages as long as their own fault does not exceed the total fault of the defendants.

That rule typically becomes significant in a multi-vehicle wreck because one driver's actions may have contributed to another driver's conduct and the resulting injuries. For example, evidence may need to establish whether one driver caused the initial contact while another driver's speed, following distance, or maneuver contributed to a subsequent collision. Each person's percentage of responsibility can affect the amount ultimately recoverable.

When multiple drivers provide different accounts, photographs, witness statements, vehicle damage, medical records, and available video can help establish the sequence of events. A car accident lawyer can compare that evidence and evaluate how comparative negligence may affect an injured person's claim.
