How Does Insurance Work After a Car Accident in Medford, MA?

After a car collision in Medford, understanding how Massachusetts insurance law applies to your situation is one of the most important early steps you can take. Massachusetts operates under a no-fault insurance system, which means that after a crash, each driver's own personal injury protection coverage, commonly referred to as PIP, is the first source of compensation for medical expenses and a portion of lost income, regardless of who caused the collision.

Massachusetts requires drivers to carry a minimum of eight thousand dollars in PIP coverage, but the costs associated with a serious crash can exceed that amount quickly, particularly when injuries require ongoing treatment or rehabilitation.

When medical costs and other losses go beyond what PIP covers, Massachusetts law allows those hurt to step outside the no-fault system and pursue a claim directly against the at-fault driver under certain circumstances. This typically applies when injuries meet a defined threshold, such as medical expenses exceeding a set amount or injuries that result in permanent or serious harm.

An attorney can help you understand whether your injuries meet that threshold, and what additional compensation may be available as a result. Uninsured and underinsured motorist coverage may also be worth reviewing if the at-fault driver's policy limits are insufficient to cover the full extent of your losses.

Navigating Massachusetts insurance laws after a crash can be challenging, particularly when determining which benefits and sources of compensation may be available. A thorough review of the circumstances can help identify all applicable insurance policies, assess whether the injuries meet the threshold for a liability claim beyond PIP benefits, and evaluate the full extent of potential damages.

Professional legal guidance from a personal injury lawyer can also help manage communications with insurance companies, protect the integrity of a claim, and ensure that no available avenue for compensation is overlooked.
