How Is Fault Determined After a Pedestrian Crash in Falmouth, MA?

Determining fault in a pedestrian collision commonly requires a careful review of the facts rather than assuming either the driver or the person on foot was responsible. In Massachusetts, liability depends on whether someone failed to exercise reasonable care under the circumstances. Evidence such as witness statements, surveillance footage, photographs, vehicle damage, and the roadway layout may all help establish how the collision occurred.

Massachusetts applies a modified comparative negligence rule. An injured pedestrian may recover compensation if they are not more than 50% responsible for the collision, although any recovery is generally reduced by their percentage of fault.

Questions about crosswalks, traffic signals, visibility, speed, and whether either party violated traffic laws may all become relevant when liability is evaluated.

Since fault is not always immediately clear, it can make a significant difference to preserve evidence soon after the collision. Medical records and documentation of the injuries may also help demonstrate the extent of the losses related to the crash.

As the available evidence is reviewed, a personal injury lawyer in Massachusetts can explain how state negligence laws apply and assess whether the facts support a legal claim.
