How Long Do You Have to File a Pedestrian Injury Claim in Taunton, MA?

Massachusetts law generally gives an injured pedestrian three years from the date of a crash to file a personal injury lawsuit, a deadline known as the statute of limitations.

While three years may sound like a lot of time, cases that involve serious injuries can take much longer to fully understand, since medical treatment and recovery usually need to progress before the full extent of harm is known.

The road to recovery after a pedestrian accident can stretch on for months, and family members are frequently focused entirely on medical decisions rather than legal deadlines in the early aftermath. This is understandable, but it also means the clock on a potential claim is already running, even while a person remains hospitalized or unable to communicate.

Massachusetts follows a modified comparative negligence rule, in which a pedestrian can recover damages as long as they're found 50% or less at fault for the crash, but building that case requires evidence that can be harder to obtain the longer a family waits.

A personal injury lawyer  can gather police reports, surveillance footage, and witness statements well before the statute of limitations becomes a concern, ensuring the evidence supporting a claim doesn't disappear while a family focuses on recovery.

Filing deadlines can feel like the last thing a family should be thinking about while a loved one is still healing. At Fiorentino Legal, P.C., we can help track that timeline so nothing gets missed later on.
