After a car accident, evidence from a busy highway can change fast. Vehicles get towed, then repaired or sold for salvage. Skid marks and debris fade with traffic and weather, and cameras at nearby businesses may record over footage within days. A claim usually turns on proof of what happened rather than on memory alone, so what gets kept early can matter later.
Anyone who expects a claim after a crash is advised to keep relevant evidence. Courts can penalize a party who lets it be lost or discarded, a problem known as spoliation.
An important fact to know is that many modern vehicles store data through an event data recorder. This device can capture speed, braking, and seat belt use in the seconds before a vehicle stops, and that information can be overwritten or lost if the vehicle is repaired or scrapped.
Businesses nearby the accident location run cameras that overwrite footage on a short cycle, so a request made early has a better chance of finding it. A car accident lawyer in Massachusetts can help send written preservation requests to insurers, tow yards, and businesses, arrange for a vehicle's data to be downloaded, and gather police reports and witness statements before those details fade.
