Our thoughts are with everyone involved, and we wish them a strong recovery.
After an injury accident, Massachusetts sets minimum bodily injury liability limits at $20,000 per person and $40,000 per accident for registered vehicles. Those figures cap what one driver's policy pays out, and everyone hurt shares the per-accident amount. When several people need treatment, that total can run out quickly. Many drivers buy higher limits, but some carry only the minimum.
However, other coverage may help fill the gap. Personal Injury Protection, commonly known as PIP, pays up to $8,000 in medical bills and lost wages regardless of fault. Uninsured motorist coverage can also apply in Massachusetts when an at-fault driver's limits are lower than the losses, depending on the policy's terms. Umbrella policies or an employer's commercial policy may add more coverage if a work vehicle was involved.
Drivers on busy routes like Lynn Fells Parkway usually come from several nearby cities, so more than one insurer may be part of a claim. Each insurer may handle timing, documentation, and settlement offers differently. When limits are shared, how one claim is resolved can affect what remains for others.
A car accident lawyer can help identify every policy that may apply, track medical bills, and explain how competing claims may affect available coverage.
