Our thoughts are with everyone affected as they recover.
Personal Injury Protection, known as PIP, is Massachusetts no-fault coverage that pays certain medical bills and lost wages regardless of who caused an injury from a car accident. Every compulsory auto policy in the state carries at least $8,000 of it. It generally applies to the policyholder, household members, and passengers.
That coverage does not settle every question, though. Under Massachusetts law, a person generally can seek pain and suffering damages from an at-fault driver only after meeting a tort threshold: more than $2,000 in reasonable medical expenses, or an injury such as a fracture, loss of sight or hearing, permanent and serious disfigurement, or death. Only reasonable and necessary bills count toward that dollar figure, so it matters a lot how the treatment gets documented.
Insurers can ask for treatment records, proof of income, and signed forms, and gaps in any of them may slow payment or lead to disputes over what counts toward the threshold. A car accident lawyer in Massachusetts can help review medical bills, track the threshold, and explain how PIP, health insurance, and a claim against another driver's insurer fit together.
