Fault is rarely all-or-nothing after an accident that involves someone on foot or on wheels. Insurance adjusters tend to look closely for ways to assign part of the blame to the person who was harmed, such as where they crossed or how visible they were.
Under Massachusetts law, a person can still recover if their share of fault is not greater than the fault of the party they are pursuing, and any award is reduced by their percentage of responsibility.
Traffic patterns in Taunton vary widely, and those differences can shape how fault is argued. Speed, sight lines, and the number of intersections may all come up. An insurer may point to any of them to argue that a person shared the blame.
Percentages can change what a claim is worth, so evidence plays a key role in these disputes. Security video from nearby businesses, photographs of the roadway, witness contact details, and prompt medical records can all help show what happened, and some footage is overwritten within days. A personal injury lawyer in Massachusetts can help identify which sources exist, send preservation requests, and organize the records an adjuster may ask about.
