Who Is Liable When a Vehicle Strikes a Scooter Rider in Haverhill, MA?
Liability in a vehicle-versus-scooter crash usually comes down to which party had the right-of-way at the moment of impact, along with whether the driver was keeping a proper lookout for smaller, harder-to-see vehicles like scooters.
Massachusetts treats scooter riders similarly to bicyclists in many respects, meaning to say that drivers are generally expected to exercise added caution around them, particularly in residential or mixed-use areas.
Because a scooter offers little physical protection, injuries in this type of crash tend to be more severe than those in a typical vehicle-to-vehicle collision, even at lower speeds, and can include fractures, road rash, or head injuries depending on whether a helmet was worn.
When the person involved is a minor, any potential claim would need to be pursued on her behalf by a parent or legal guardian, which can add an extra layer to how the case moves forward. A Massachusetts personal injury lawyer can be particularly useful in a case that involves a minor, both in navigating the legal steps required for a parent to file on a child's behalf and to make sure medical documentation is preserved early.
Massachusetts follows a modified comparative negligence rule, so if a teen is found to share some responsibility for the crash, any recovery would be reduced accordingly rather than barred outright, as long as their share of fault doesn't exceed 50%.
