Insurance companies handle car accident claims by opening a claim, assigning an adjuster, reviewing the crash and injuries, and then deciding whether to accept the claim, deny it, or make a settlement offer.
When you seek early benefits after a Massachusetts crash, your own auto insurer generally handles Personal Injury Protection. PIP can pay medical expenses and part of your lost wages regardless of who caused the collision, subject to applicable coverage limits.
As the insurer reviews the claim, police reports, photographs, and witness accounts may help show how the crash happened. These materials can also help the adjuster compare each driver’s account with other available information.
After PIP benefits are considered, you may be able to seek additional compensation from an at-fault driver. Depending on your losses, this may include uncovered medical costs, lost income, and compensation for pain and suffering.
If you share some responsibility for the collision, Massachusetts law reduces your compensation by your percentage of fault. You generally cannot recover if your share of fault is greater than the combined fault of the people you are pursuing.
Before accepting an early settlement offer, consider whether it accounts for the full extent of your losses. Once you accept a settlement and sign a release, you generally cannot seek additional payment for the same claim.
When the insurance company questions your claim, a car accident lawyer can review the records, address disputes over fault or your losses, and communicate with the insurer on your behalf. An attorney can also review a settlement offer and explain whether it accounts for the losses included in your claim.
