How OUI Crash Injury Claims Work on Southampton, MA Roads
When a driver is arrested for operating under the influence after striking pedestrians in Massachusetts, the criminal case and any civil personal injury claim run on separate tracks. A criminal conviction can strengthen a civil claim, but families do not need to wait for the criminal process to conclude before pursuing compensation. In Massachusetts, injured people generally have three years from the date of the crash to file a personal injury claim, and to act earlier helps preserve evidence and witness accounts.
Southampton sits in Hampshire County along a network of rural and semi-rural roads that connect to busier corridors throughout the Pioneer Valley. In these zones, pedestrian activity and vehicle traffic regularly intersect. OUI-related crashes on these roads can have devastating consequences, particularly when children are involved.
Serious injuries from a drunk driving crash can include broken bones, traumatic brain injury, internal trauma, and harm that requires extended hospitalization and rehabilitation. For a young child, the long-term effects of such injuries may not be fully understood for months or years. The financial and emotional toll on a family can be significant and lasting.
A personal injury attorney can pursue a civil claim alongside or following the criminal case, seeking compensation for medical expenses, future care needs, lost income, and pain and suffering. Legal guidance can also help a family navigate communications with insurance companies and make sure no deadlines are missed.
