What Legal Options Do Parents Have After Losing a Child in a Bicycle Crash in Franklin, MA?
When a child is killed while riding a bicycle in Franklin, parents may be able to pursue a wrongful death claim under Massachusetts law. That process can move forward independently of any determination about whether the driver will face criminal charges.
In Massachusetts, parents of a deceased minor are among the family members eligible to bring a wrongful death claim when their child is killed due to another party's negligence. Establishing how the collision occurred, including the driver's speed, attentiveness, and adherence to traffic laws at the time of the crash, will be central to determining liability and the strength of any wrongful death claim pursued on the child's behalf.
The decision about whether criminal charges will be filed against the driver is a separate process from any civil wrongful death claim the family may pursue, and parents do not need to wait for that determination before consulting an attorney about their legal options. A criminal investigation and a civil claim serve different purposes and operate under different standards of proof, meaning a family can move forward with a wrongful death claim regardless of the outcome of any criminal proceedings or even if no charges are ultimately filed.
The losses that parents may be able to pursue in a Massachusetts wrongful death claim involving a minor child can include funeral and burial costs, and the loss of the child's future companionship and the relationship parents would have continued to share with their child.
Because the loss of a child is among the most devastating experiences a family can endure, a wrongful death attorney may be able to help parents understand the full scope of compensation that may be available, gather evidence establishing how the crash occurred, and ensure that any resolution reached reflects the full and lasting impact of their loss.
