What Are My Legal Rights After Being Struck by a Vehicle in Massachusetts?

Pedestrians struck by vehicles in Massachusetts have the right to immediate medical coverage through No-Fault insurance and the right to seek damages for pain and suffering if the driver is found to be at fault. Because injuries in these cases are often catastrophic, navigating the "coordination of benefits" between insurance policies is a critical first step.

Massachusetts law requires all auto insurance policies to include Personal Injury Protection (PIP). Even as a pedestrian, you are covered by these benefits. PIP typically pays the first $8,000 for medical expenses and a portion of lost wages. If you have your own auto policy, your insurance pays; if you do not, you are covered by the policy of a household member or the policy of the driver who hit you. Understanding how PIP interacts with your private health insurance is vital to ensuring that specialized care is paid for promptly.

To sue the at-fault driver for "noneconomic damages", such as physical pain, mental anguish, and loss of enjoyment of life, your case must meet the state's tort threshold. In Massachusetts, this requires that you have incurred more than $2,000 in reasonable medical expenses or have suffered a permanent injury, such as a fractured bone or significant scarring.

Additionally, Massachusetts follows a 51% Comparative Negligence rule: you can still recover compensation as long as you were not more than 50% responsible for the accident. Securing the crash report and any available surveillance footage from nearby businesses is essential to proving the driver had the "last clear chance" to avoid the collision.

If you’ve been injured as a pedestrian, having someone guide you through the next steps can make things easier. A lawyer can help handle insurance communication, keep your records organized, and make sure your case is moving forward while you focus on your recovery.

Consulting with an attorney can help you understand your rights, explore all possible avenues for compensation, and ensure that your claim is handled appropriately.
