What Are the Next Steps for Families After a Fatal Crash in Massachusetts?
Following a fatal accident in Massachusetts, families should prioritize opening an estate to appoint a personal representative and securing all available insurance data to address funeral costs and lost future income. Taking these specific steps ensures that the family’s legal rights are protected while the official investigation into the crash continues.
1. Appoint a Personal Representative through Probate
In Massachusetts, a wrongful death claim cannot be filed by just any family member; it must be brought by the Executor or Administrator of the deceased person’s estate. One of the first legal steps is to petition the Probate Court to appoint this personal representative. This individual is granted the authority to act on behalf of the surviving "next of kin" (usually a spouse, children, or parents) to pursue a settlement or lawsuit against the negligent party.
2. Identify All Sources of Insurance Recovery
While Massachusetts is a "No-Fault" state, motorcycles are unique because they are generally excluded from Personal Injury Protection (PIP) benefits. This means the family must look elsewhere for immediate financial relief. You should immediately review the deceased’s insurance policy for Medical Payments (MedPay) coverage, as well as Underinsured Motorist (UIM) coverage. UIM is critical if the at-fault driver’s insurance limits are too low to cover the full extent of the family's financial loss.
3. Secure the Official Traffic Unit Investigation Report
Families should obtain a copy of the police reconstruction of the scene. This document contains vital data, including vehicle speeds, points of impact, and witness statements. In 2026, many streets are monitored by city cameras or private security; a legal professional can help issue "spoliation letters" to ensure this video evidence is preserved before it is overwritten.
4. File a Wrongful Death Claim
Under the Massachusetts Wrongful Death Act, families can seek compensation for more than just medical and funeral bills. You have the right to pursue damages for the loss of the deceased’s expected net income, as well as "loss of consortium", which is the loss of companionship, comfort, and guidance.
