Can a Family Sue After a Pedestrian Is Killed by a Carjacked Vehicle in Boston, MA?

Yes, a family can pursue a wrongful death claim after a pedestrian is killed by a driver operating a stolen or carjacked vehicle, and the criminal nature of the underlying offense does not eliminate the family's civil legal options under Massachusetts law.

When a loved one dies as a result of another person's careless or deliberate actions, eligible surviving family members in Massachusetts, such as parents, children, and spouses, may file a wrongful death lawsuit. The family's position is strengthened by the fact that the driver has been arrested and will be charged with a crime. This is because the driver is a known and identifiable party against whom a civil claim can be made, and the family does not have to wait for the criminal case to be resolved before pursuing a civil action.

One important consideration in cases involving a stolen or carjacked vehicle is how insurance coverage applies when the driver operating the vehicle was not its rightful owner. Many auto insurance policies contain exclusions for unauthorized use of a vehicle, which can limit or eliminate coverage under the vehicle owner's policy when a car has been stolen or carjacked.

However, other potential sources of compensation may still be available depending on the specific circumstances, including the suspect's own personal assets, any applicable insurance the suspect may carry independently, or other avenues that an attorney can help identify based on a full investigation into the case.

In a Massachusetts wrongful death claim, surviving family members may be able to recover substantial and varied financial damages. Depending on the particular circumstances, damages may include the financial worth of the deceased's future earning potential, funeral and burial expenses, and the long-term loss of support, companionship, and guidance.

A wrongful death lawyer might be able to guide the family through the difficulties brought on by the criminal nature of this case, help them find all possible sources of compensation, and make sure that any settlement reached accurately captures the full and long-lasting impact of their loss.
