What Legal Options Does an Officer Have After Being Hurt on the Job in Brockton, MA?
When a police officer is hurt while responding to a call in Brockton, they generally have access to workers' compensation benefits through their employer, which can cover medical expenses and a portion of lost income regardless of how the crash occurred.
However, workers' compensation alone may not fully address the scope of losses that result from a serious on-the-job injury, and a separate civil personal injury claim against another at-fault driver may also be available depending on the circumstances.
The distinction between workers' compensation and a civil personal injury claim is significant for officers hurt in vehicle-related incidents while on duty. Workers' compensation provides benefits regardless of fault but is generally limited in the types of damages it covers, as compensation for pain and suffering is typically not included under workers' compensation alone.
A civil claim against an at-fault third party, by contrast, may allow an officer to pursue a broader range of damages, including pain and suffering, permanent impairment, and the long-term impact of injuries on quality of life and career. In Massachusetts, an injured worker can generally pursue both workers' compensation benefits and a third-party civil claim simultaneously when another driver's negligence contributed to the incident.
Depending on the circumstances, being injured while responding to an emergency call can have a wide range of physical repercussions, from minor injuries to more severe trauma necessitating prolonged medical care and rehabilitation.
In addition to identifying all pertinent insurance coverage and ensuring that any settlement reached takes into account the immediate and long-term effects of the injuries sustained while performing their duties, a personal injury lawyer may be able to assist an officer in understanding the full scope of compensation that may be available across both workers' compensation and any applicable civil claim.
