What Legal Options Do Families Have After a Fatal Crash Outside the Workplace in East Brookfield, MA?

When an employee is killed in a crash outside their workplace, surviving family members may be able to pursue a wrongful death claim under Massachusetts law, and that process can move forward independently of any ongoing police investigation into how the crash occurred.

In Massachusetts, eligible surviving family members, including a spouse, children, and parents, may bring a wrongful death claim when a loved one is killed due to another party's negligence.

One important consideration in cases involving a workplace location is whether the crash occurred while the deceased was actively working, commuting to a job site, or otherwise engaged in employment-related activity, as the specific timing and circumstances can affect what legal avenues are available.

In some situations, a fatal crash connected to a person's employment may open the possibility of workers' compensation benefits in addition to a civil wrongful death claim against an at-fault driver, depending on the precise facts involved. A careful review of these circumstances by an attorney can help families understand which legal paths apply to their specific situation.

In a Massachusetts wrongful death claim, surviving family members may be able to recover substantial and extensive financial damages. Depending on the particulars of the collision, damages may include the economic worth of the deceased's future earning potential, funeral and burial expenses, and the long-term loss of companionship, direction, and support.

A wrongful death lawyer may be able to monitor any ongoing investigation as findings emerge, assist families in understanding the full extent of compensation that may be available, and guarantee that any settlement reached fully and permanently addresses the impact of their loss.
