How Long Families Have to File a Wrongful Death Lawsuit in Massachusetts
In Massachusetts, families who have lost a loved one due to someone else’s negligence or wrongful conduct must follow a specific time limit to file a wrongful death lawsuit. This time limit is known as the statute of limitations, and it plays a critical role in determining whether a claim can move forward in court. In most cases, the statute of limitations for a wrongful death claim in Massachusetts is three years from the date of the deceased person’s death. If a claim is not filed within this period, the right to pursue compensation may be permanently lost, regardless of the merits of the case.
The three-year timeframe is generally calculated from the date of death, not the date of the accident or incident that caused the death. This distinction is important in situations where a person may have survived for some time after the incident before passing away. In such cases, the clock typically begins on the date of death itself. However, there can be exceptions depending on the circumstances, such as cases involving delayed discovery of negligence or claims involving government entities, which may have shorter notice requirements and additional procedural rules.
Because wrongful death cases often involve complex investigations, families are encouraged to begin the process as soon as possible. Gathering evidence, identifying responsible parties, and consulting with legal counsel can take time, and acting early helps preserve important information. Evidence such as police reports, medical records, witness statements, and expert analysis may become more difficult to obtain as time passes.
It is also important to understand that wrongful death claims in Massachusetts are typically brought by the personal representative of the deceased person’s estate. This individual is responsible for filing the claim on behalf of the surviving family members and beneficiaries. Working with an attorney can help ensure that all procedural requirements are met and that the claim is filed within the applicable deadline.
Failing to file within the statute of limitations generally results in the court dismissing the case. For this reason, families considering a wrongful death claim should seek guidance early to protect their legal rights and avoid missing critical deadlines.
