What Should Drivers Know About Fault After an Accident Near Perryville Rd in Webster, MA?

In Massachusetts, fault after a vehicle accident is generally decided under the state's modified comparative negligence rule: a driver found 51% or more at fault cannot recover damages, while one who is less at fault can still recover a reduced amount.

These types of impact can cause whiplash, soft-tissue damage, or fractures that are not always obvious right away. Some people feel fine immediately afterward, only to develop pain or stiffness in the days that follow, which is why prompt medical evaluation matters.

Massachusetts law generally gives injured drivers three years from the date it occurred to file a personal injury lawsuit under the state's statute of limitations. A Massachusetts car accident lawyer can help determine which insurance policies may apply, including the state's mandatory personal injury protection (PIP) coverage, and can explain how fault percentages under the comparative negligence rule might affect a potential claim.
