Fault Questions That Arise After a Multi-Vehicle Accident in Falmouth, MA

When three vehicles are involved in the same accident, injuries can range from whiplash and soft-tissue strain to more serious fractures, particularly when the vehicles involved differ in size. Symptoms like stiffness or nerve pain don't always appear right away, which is one reason prompt medical evaluation matters even when a person feels fine at the scene.

Massachusetts follows a no-fault insurance system, which means each driver's own personal injury protection (PIP) coverage generally pays initial medical bills regardless of who caused the accident.

Once medical costs or lost wages exceed certain thresholds, an injured driver may be able to step outside the no-fault system and pursue a claim against another driver. With three vehicles involved, fault can be split unevenly among the drivers, and Massachusetts' modified comparative negligence rule bars recovery for anyone found 51% or more responsible.

Sorting out how fault should be divided among multiple separate drivers can get complicated quickly, and a Massachusetts car accident lawyer can help review police reports, vehicle damage, and any available witness accounts to help clarify what happened.
