How Does Fault Get Determined in a Motorcycle Crash in Holland, MA?
Motorcycle crashes tend to draw extra scrutiny during an investigation, partly because motorcyclists are more vulnerable and partly because bias against riders can unfairly influence early assumptions about fault.
Massachusetts requires motorcyclists to carry the same types of insurance as other drivers, but a motorcycle's smaller profile means a car driver's failure to check blind spots or yield at an intersection can have much more severe consequences than a typical car-to-car crash.
Physical evidence, like skid marks, vehicle damage patterns, and the final resting position of both vehicles, frequently plays a larger role in reconstructing what happened in a motorcycle crash than witness accounts alone.
Injuries in a motorcycle collision tend to be more serious than in an enclosed vehicle, given the lack of any physical barrier between the rider and the point of impact. Road rash, fractures, and head trauma are common, even in crashes that might otherwise be considered minor if two cars were involved instead.
Massachusetts follows a modified comparative negligence rule, so a rider found 50% or less at fault can still recover damages, reduced by their own share of responsibility. Because motorcyclists sometimes face an uphill battle with insurance adjusters who assume fault based on stereotypes rather than facts, a Massachusetts motorcycle accident lawyer can be especially useful in making sure the physical evidence is properly documented and presented.
