Does Auto Insurance Cover Pedestrian Injuries in Massachusetts?
Auto insurance in Massachusetts can cover pedestrian injuries in certain situations. Personal Injury Protection, known as PIP, and bodily injury liability coverage are the two main sources that may apply. The type of coverage available depends on the details of the crash and how fault is determined.
Massachusetts PIP benefits can extend to pedestrians hurt in a crash. This coverage may apply regardless of who caused the accident. It can address initial medical expenses and a portion of lost wages up to policy limits.
A driver’s bodily injury liability coverage may also become relevant after a pedestrian accident. This coverage typically applies when the driver is found to be at fault. A pedestrian may file a claim against the at-fault driver’s policy to seek additional compensation.
Massachusetts law sets thresholds that affect when a pedestrian can pursue damages beyond basic PIP coverage. Serious injuries or medical expenses above a certain amount may allow a pedestrian to seek further recovery. These rules determine what additional claims may be available based on the severity of the injury.
Some accidents involve drivers who carry little or no insurance. In those cases, uninsured or underinsured motorist coverage may provide a way to recover damages. Pedestrians may access this coverage through a family member’s policy or another applicable source.
After a pedestrian accident, reporting the crash to authorities is an important first step. Seeking medical attention promptly helps document injuries tied directly to the incident. Filing claims with the relevant insurance carriers promptly helps preserve access to available benefits.
Consulting with a personal injury lawyer
can be helpful, as they can explain how Massachusetts insurance rules apply to a pedestrian injury claim. Legal guidance can also help clarify what steps to take and what documentation to gather.
