Can a Passenger Seek Compensation After an Injury Crash in Massachusetts?
A passenger injured in a car crash in Massachusetts can generally seek compensation for their injuries and related losses. Claims may be filed against one or multiple drivers, depending on who bears liability for the accident. Eligibility to pursue a claim does not depend on which vehicle the passenger was traveling in.
A passenger may file a claim against the driver of the vehicle they were in, another driver involved in the crash, or both. When more than one party contributed to the collision, shared liability may apply. The specific parties named in a claim depend on the circumstances of the accident.
Massachusetts operates under a no-fault insurance system. Personal Injury Protection, known as PIP, provides initial coverage to passengers for medical expenses and lost wages regardless of fault. This coverage applies first before other claims can move forward.
Passengers may step outside no-fault limits when injuries meet certain severity thresholds or medical expenses exceed defined amounts. At that point, a passenger may pursue additional compensation through a liability claim. This pathway depends on the nature and extent of the injuries sustained.
Compensation a passenger may recover includes medical bills, lost income, and damages related to pain and physical limitations. These categories address both the financial and personal impact of the crash. Each case is evaluated based on its own facts and documented losses.
After a crash, passengers should seek medical attention as soon as possible, even if symptoms seem minor at first. Documenting injuries, keeping records of treatment visits, and preserving any evidence from the scene can all support a future claim. Early action helps establish a clear connection between the accident and the injuries reported.
