Do I Need a Lawyer After a Motorcycle Accident in Massachusetts?
While hiring a lawyer after a motorcycle accident in Massachusetts is not legally required, having one can make a significant difference in the outcome of a claim. Motorcycle crashes often result in serious injuries, complex insurance negotiations, and disputes over fault, all of which can be difficult to manage without legal guidance. An attorney can help victims understand their options and avoid common mistakes that may affect their ability to seek compensation.
Massachusetts is a no-fault insurance state, which means your own Personal Injury Protection coverage, or PIP, pays for initial medical expenses after a crash regardless of who caused it.
Crashes involving large vehicles like dump trucks add another layer of complexity. These cases may involve commercial insurance policies, employer liability, vehicle maintenance records, and federal trucking regulations. Identifying all potentially responsible parties, which could include the truck driver, a trucking company, or a vehicle owner, is an important step that a personal injury lawyer
can help navigate.
The statute of limitations for motorcycle accident claims in Massachusetts is three years from the date of the crash. While three years may seem like plenty of time, building a strong case takes preparation. Evidence from the scene, witness statements, medical records, and expert assessments all need to be gathered and organized. Starting early gives both the victim and their attorney the best foundation to work from.
