Amesbury, MA (July 14, 2026) – An elderly man suffered a spinal fracture on Monday, July 13, after a car rolled off a tow truck and struck an apartment building.
The incident happened around 10:40 a.m. at 53 Congress Street. According to witnesses, a tow truck driver had loaded the car but reportedly failed to secure it properly before it rolled off.
The car struck one of the building's balcony supports after coming loose. The man was taken to the hospital for treatment of his spinal injury.
The Amesbury Police continue to actively investigate.
We hope the injured man has a full and steady recovery.
Who Is Liable When an Unsecured Tow Truck Vehicle Causes Injury in Amesbury, MA?
When a vehicle rolls off a tow truck due to improper securing, liability typically falls on the tow operator and potentially the towing company itself, since securing a load correctly is a basic duty of the job.
A spinal fracture can bring lasting consequences, including reduced mobility, chronic pain, or the need for ongoing physical therapy well beyond the initial hospital stay. Injuries to the spine tend to require specialists to monitor recovery over months rather than weeks.
Massachusetts law allows an injured person to pursue a claim against the tow company for negligent securing of the vehicle, and depending on the equipment used, a product liability claim could also apply if a strap or locking mechanism failed unexpectedly. A Massachusetts personal injury lawyer can help obtain the tow truck's maintenance and inspection records, along with any equipment manuals, before that documentation becomes harder to track down.
