Can a Victim Sue After Falling From a Vehicle Operated by an Impaired Driver in Boston, MA?

Yes, a person seriously hurt after falling from a vehicle operated by an impaired driver can pursue a civil personal injury claim under Massachusetts law, and that process can move forward independently of any criminal case the driver may face.

When a driver operating under the influence contributes to circumstances that lead to a passenger falling from a moving vehicle, that impairment can serve as significant evidence of negligence in a civil claim. Driving while impaired is widely recognized as a failure to exercise the level of care necessary to keep passengers and others on the road safe.

The circumstances surrounding the driver's actions after the incident may also become relevant. In this case, the fact that the driver initially left the scene before later returning and cooperating with authorities raises additional questions that could factor into a civil claim. Although the driver's eventual return may influence the criminal investigation, the initial decision to leave the scene could still be considered when evaluating the driver's conduct and state of mind at the time of the incident.

As both the criminal and civil processes move forward, evidence gathered during the OUI investigation may become particularly important. Field sobriety testing, blood alcohol content results, officer observations, and other findings from the arrest could all play a role in establishing negligence in a personal injury case, regardless of how the criminal charges are ultimately resolved.

At the same time, the injuries associated with falling from a moving vehicle can be severe and life-altering. Traumatic brain injuries, fractures, internal injuries, and significant abrasions often require extensive medical treatment, rehabilitation, and a lengthy recovery period.

Because of these potential long-term consequences, understanding the available legal options early can be important. A personal injury attorney may be able to help the injured passenger evaluate any civil claims separate from the criminal proceedings, identify all available insurance coverage, and pursue compensation that reflects the full extent of the injuries and losses resulting from the incident.
