The cause of the collision has not yet been determined, and the incident remains under investigation by local authorities. We extend our thoughts to those affected by this incident and hope for a full recovery for the injured individual.
What Happens If the At-Fault Driver Is Uninsured in Massachusetts?
When a car accident occurs in Massachusetts and the at-fault driver does not have insurance, injured parties may still have options to seek compensation. Massachusetts law requires all drivers to carry auto insurance, but uninsured drivers are unfortunately still involved in collisions. In these situations, claims are often handled through the injured party’s own insurance policy.
One common source of recovery is uninsured motorist (UM) coverage. This type of coverage is designed to protect drivers and passengers if they are injured by a driver who does not have insurance. UM coverage can help pay for medical expenses, lost wages, and other damages resulting from the crash, up to the limits of the policy.
In some cases, underinsured motorist (UIM) coverage may also apply if the at-fault driver has insurance, but their policy limits are insufficient to cover the full extent of the damages. This allows the injured party to pursue additional compensation through their own insurer.
If insurance coverage is not available or does not fully cover the losses, the injured party may consider pursuing a personal injury lawsuit directly against the at-fault driver. However, collecting compensation in such cases can be challenging if the driver lacks sufficient assets.
Because these claims can involve complex insurance rules and deadlines, individuals need to act promptly. Gathering evidence, documenting injuries, and reviewing available insurance coverage are critical steps in protecting one’s rights after a crash involving an uninsured driver.
